These Terms and Conditions govern all sales of products carried out through the website www.tenutecristiano.com, in accordance with applicable Italian and European legislation on e-commerce and distance selling.
By placing an order, the Customer declares to have read, understood, and accepted these Terms and Conditions in full.
1. Definitions
- Seller: Azienda Agricola Antonio Cristiano
- Customer: any natural or legal person purchasing products through the website
- Products: food products, including extra virgin olive oil and related items, offered for sale on the website
- Contract: the online sales contract concluded between Seller and Customer
2. Subject of the Contract
These Terms and Conditions govern the sale of Products selected by the Customer and available in the online catalogue at the time of order placement.
Product availability is subject to stock. In case of unavailability after the order has been placed, the Seller will promptly inform the Customer.
3. Product Information, Prices and Characteristics
All prices are expressed in Euro (€) and include VAT, unless otherwise specified.
The price applicable to the order is the one displayed at the time the order is placed and confirmed. Prices are fixed and final.
Product images are for illustrative purposes only and may not perfectly represent the final product. Any differences shall not affect the essential characteristics of the Products, particularly in the case of artisanal or agricultural goods.
The Customer is solely responsible for selecting the Products ordered.
4. Orders and Contract Conclusion
Each order placed through the website constitutes a contractual proposal by the Customer.
The Contract is concluded only when the Seller sends an order confirmation email, summarising:
- ordered Products
- prices
- shipping costs
- delivery terms
The Seller reserves the right to refuse or cancel an order in case of:
- product unavailability
- errors in pricing or product information
- suspected fraudulent activity
5. Payment Methods
Accepted payment methods include:
- credit and debit cards
- PayPal
- any other payment methods made available at checkout
Payments are processed through secure third-party platforms. The Seller does not store or have access to the Customer’s payment details.
6. Shipping and Delivery
Shipping Rates
Italy
- Flat shipping rate: €5.00
- Free shipping for orders of €100.00 or more
International
- Shipping costs are calculated automatically based on destination and shown before order confirmation.
- Free shipping thresholds, where applicable, may vary by country.
Delivery Times
Estimated delivery times:
- Italy: within 7 business days
- Europe: within 15 business days
Delivery times are indicative and non-binding. Delays of less than 30 days do not entitle the Customer to cancel the order or claim compensation.
The Seller reserves the right to make partial deliveries where necessary.
7. Delivery and Inspection
Upon delivery, the Customer must verify:
- the integrity of the packaging
- the quantity of delivered items
Any visible damage or discrepancies must be reported immediately to the courier and noted on the delivery document.
8. Transport Damage
Any damage or non-conformity attributable to transport must be reported within 8 days of delivery by email to info@tenutecristiano.com, including:
- order number
- description of the issue
- photographic evidence
Upon verification, the Seller will replace the damaged Product or issue a refund.
Failure to report within the indicated timeframe will result in loss of the right to replacement or refund.
9. Legal Warranty of Conformity
Products are covered by a 24-month legal warranty for lack of conformity, pursuant to applicable consumer protection laws.
The Customer must notify the Seller of any defect within 2 months of discovery.
The warranty does not cover damage caused by:
- improper use
- incorrect storage
- normal wear and tear
10. Right of Withdrawal
Consumers have the right to withdraw from the Contract within 14 days from receipt of the Products, without providing any reason.
To exercise the right of withdrawal, the Customer must notify the Seller by email to info@tenutecristiano.com, specifying:
- order number
- Products to be returned
Returned Products must be:
- unused
- unopened
- in original packaging
Return shipping costs are borne by the Customer.
Refunds will be issued within 14 days of receipt of the returned Products, using the same payment method as the original transaction.
11. Force Majeure
The Seller shall not be liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to:
- strikes
- transport disruptions
- natural disasters
- governmental restrictions
- internet or system failures
12. Limitation of Liability
Except in cases of wilful misconduct or gross negligence, the Seller shall not be liable for indirect or consequential damages.
The Seller is not responsible for fraudulent use of payment methods by third parties.
13. Retention of Title
Products remain the property of the Seller until full payment has been received.
14. Intellectual Property
All content on the website, including texts, images, logos, and trademarks, is the exclusive property of the Seller and may not be reproduced or used without prior written consent.
15. Governing Law and Jurisdiction
These Terms and Conditions are governed by Italian law.
Without prejudice to mandatory consumer protection provisions, any dispute arising out of or related to these Terms and Conditions shall fall under the exclusive jurisdiction of the Court of Lamezia Terme (Italy).
16. Final Provisions
If any provision of these Terms and Conditions is held invalid or unenforceable, the remaining provisions shall remain fully effective.
These Terms and Conditions constitute the entire agreement between the parties.
